TERMS & CONDITIONS USE OF CLUB PANASONIC WEBSITE

The following are terms of a legal agreement between you and Panasonic Malaysia Sdn. Bhd (26975-W). ("PM"), its subsidiaries and/or affiliates ("Panasonic"). By accessing, browsing or using this CLUB Panasonic Website ("Site"), you indicate your acknowledgment and acceptance of the following terms and conditions:

 1. Laws and Regulations

      Your access and use of this Site shall be subject to applicable laws and regulations.

 2. Copyright and Trademarks

      The trademarks, logos and service marks ("Marks") as well as content displayed on the Site are the property of Panasonic and other parties. You are prohibited from using any Marks for any purpose without the written permission of Panasonic or such third party which may own the Marks. You should assume that all content on the Site is protected by copyright unless otherwise noted. The use of the content of the Site is prohibited unless specifically permitted by these terms and conditions. Any unauthorized use of the content or Marks may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statues.

 3. Hyperlinking

      THIS SITE MAY PROVIDE A LINK TO OTHER SITES BY ALLOWING YOU TO LEAVE THIS SITE TO ACCESS THIRD-PARTY MATERIAL OR BY BRINGING THE THIRD-PARTY MATERIAL INTO THIS SITE VIA "INVERSE" HYPERLINKS AND FRAMING TECHNOLOGY (A "LINKED SITE"). PANASONIC HAS NO DISCRETION TO ALTER, UPDATE, OR CONTROL THE CONTENT ON A LINKED SITE. THE FACT THAT PANASONIC HAS PROVIDED A LINK TO A SITE IS NOT AN ENDORSEMENT, AUTHORIZATION, SPONSORSHIP, OR AFFILIATION WITH RESPECT TO SUCH SITE, ITS OWNERS, OR ITS PROVIDERS. Panasonic prohibits caching, unauthorized hypertext links to the Site and the framing of any content available through the Site. Panasonic reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the content available on Linked Sites. Please be aware that Linked Sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on the Site and Panasonic is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

 4. No Warranties

      ALL CONTENT ON THE SITE ARE PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY OR ACCURACY. Panasonic specifically disclaims any liability or responsibility for any errors or omissions in the content on the Site. Neither Panasonic nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the Site.

 5. Limitation of Liability

      THE CONTENT ON THE SITE OR A LINKED SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS, AND PANASONIC SPECIFICALLY DISCLAIMS ANY LIABILITY FOR SUCH INACCURACIES OR ERRORS. PANASONIC DOES NOT WARRANT OR REPRESENT THAT THE CONTENT ON THE SITE IS COMPLETE OR UP-TO-DATE. PANASONIC IS UNDER NO OBLIGATION TO UPDATE ANY CONTENT ON THE SITE. PANASONIC MAY CHANGE THE CONTENT ON THE SITE AT ANY TIME WITHOUT NOTICE. PANASONIC MAY MAKE IMPROVEMENTS OR CHANGES TO THE SITE AT ANY TIME. YOU AGREE THAT PANASONIC, ITS AFFILIATES AND ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, FOR ANY INDIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, COST OF PROCURING SUBSTITUTE SERVICE OR LOST OPPORTUNITY) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE OR A LINKED SITE, OR WITH THE DELAY OR INABILITY TO USE THE SITE OR A LINKED SITE, EVEN IF PANASONIC IS MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION ON LIABILITY INCLUDES, BUT IS NOT LIMITED TO, THE TRANSMISSION OF ANY VIRUSES WHICH MAY INFECT YOUR EQUIPMENT, FAILURE OF MECHANICAL OR ELECTRONIC EQUIPMENT OR COMMUNICATION LINES, TELEPHONE OR OTHER INTERCONNECT PROBLEMS SUCH AS INABILITY TO ACCESS YOUR INTERNET SERVICE PROVIDER, UNAUTHORIZED ACCESS, THEFT, OPERATOR ERRORS, STRIKES OR OTHER LABOR PROBLEMS OR ANY FORCE MAJEURE. PANASONIC CANNOT AND DOES NOT GUARANTEE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO THE SITE.

 6. Confidentiality of Communication

      Except as required by law and in accordance to Panasonic Privacy Statement, if you send any communications or materials to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like, all such communications are, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Panasonic or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, Panasonic is free to use, without any compensation to you, any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products using such information. Panasonic shall assume no responsibility and shall not be liable for any unauthorized or unlawful interception or modification of any communication between you and Panasonic (whether by electronic mail or otherwise), or for any loss or damage arising thereby (including but not limited to any loss or damage arising out of the unauthorized or fraudulent use of any information contained in or made accessible via such communication). Although Panasonic may from time to time monitor or review discussions, postings, transmissions, bulletin boards and the like on the Site, Panasonic is under no obligation to do so and assumes no responsibility or liability arising from the contents of any such communications nor for any error, defamation, libel, obscenity, profanity, or inaccuracy contained in any such communication. You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libellous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence or give rise to civil liability, or otherwise violate any law. Panasonic will fully cooperate with any law enforcement authorities or court order requesting or directing Panasonic to disclose the identity of anyone posting such materials.

 7. Transmission of Personal Data

      You have read Panasonic Privacy Statement and, you acknowledge and agree that by providing Panasonic with any personal or proprietary information through the Site, you consent to the transmission of such personal or proprietary user information over international borders as necessary for processing in accordance with Panasonic's standard business practices. You are advised that Linked Sites may contain transmission of personal data provisions that differ from the provisions provided herein. Panasonic is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

 8. Governing Law and Jurisdiction

      You agree that these Terms and Conditions are to be governed by and construed in accordance with the laws of Malaysia, where you are domiciled, without reference to its conflicts of law rules and agree to submit to the non-exclusive jurisdiction of the Courts of Malaysia, where you are domiciled.

 9. Panasonic Limited Warranty (Service Policy)

      PM's warranty obligations for Panasonic Product(s) are limited to the terms and conditions listed below:
  9.1    PM warrants Panasonic Product(s) to be free from defects in materials and workmanship under normal use for a period of year(s) as stated in leaflet, container or box of the Product(s) from the date of purchase by the Customer.
  9.2    This limited warranty applies to Panasonic Product(s) purchased in Malaysia from PM or from PM's authorised dealers, whereby the products has been supplied by PM.
  9.3    This limited warranty is not valid unless the Customer provides the following:
  a.   the warranty card (which have not been altered, defaced or erased) duly completed and that PM's portion of the warranty card has been duly completed and posted to PM within seven (7) days of purchase of the product and provide proof of purchase with a receipt (which is dated and sufficiently itemized to clearly identify the product);
  9.4    If PM or PM's Authorised Service Dealers receives notice of a manufacturing defect or a defect of the Panasonic Product(s) arising from normal usage within the Warranty Period and a valid claim arises, PM has the following options :-
  a.   repair the product at the cost of PM, using part or parts which are new or equivalent to new in performance or reliability. Any part or parts replaced by PM or by PM's authorised service dealers shall become the property of PM;
  b.   exchange the product with a new product or equivalent to new in performance or reliability (whereby the function, performance and reliability is similar to the original product). The product for which the exchange is provided shall become the property of PM.
  9.5    This limited warranty for the product does not apply to the following:-
  a.   accessories or consumable items such as batteries, lamp unit, ink cartridges and etc.;
  b.   damage caused by normal wear and tear, improper use or mismanagement, operation of the product other than in accordance with the operating manual or instructions or attachment sheets, use of the product in a manner not reasonably contemplated by Panasonic Malaysia Sdn. Bhd., unauthorised modification of the Product or subjection of the product to unusual or unrecommended physical, environmental or electrical stress;
  c.   cosmetic damage, including but not limited to dents, cracks, scratches and stains;
  d.   damage caused by corrosion, oxidation or rust due to spillage of food and liquids or exposure to extreme moisture, thermal or environmental conditions;
  e.   damage caused by improper testing, demonstration, maintenance, installation, adjustment or alteration of any kind;
  f.   damage caused by part or parts of a product not supplied or approved by PM;
  g.   damage caused by service or repairs performed by anyone who is not a representative of PM or a PM authorised qualified technician;
  h.   the serial number of the Panasonic Product(s) being removed, defaced, made illegible or been tampered;
  i.   damage caused by using the product for household purposes in a commercial environment;
  j.   damage caused by use with any other product, ancillary equipment or software not furnished or approved by PM;
  k.   damage caused by pest, vermin or infestation of insects;
  l.   damage caused by incomplete or improper installation in accordance with the operating manual or instructions or attachment sheets;
  m.   damages caused by faulty or leaking batteries not manufactured by Panasonic;
  n.   damage caused by improper packing during shipment of the product to PM or PM's authorised service dealers;
  o.   damage caused by accident, abuse, floods, fire, winds, earthquake, lightning or other external causes; and
  p.   product maintenance demonstration, installation, routine servicing calibration and customisation of the product.
  9.6    Please take IMPORTANT NOTICE of the following:-
  a.   various product models have different specifications, function, display, appearance and performance and are not regarded as a defect in the Product(s).
  b.   for Product(s) containing data, please ensure that the date in the product has been fully 'backed up' before it is handed to PM or PM's authorised service dealers. Although PM will take reasonable efforts to return the Product(s) with all customer software programs, data or information stored on any media intact, however PM shall not be liable if during the repair of the Product(s) the contents in the Product(s)' data storage media are altered, deleted or modified in any way.
  c.   please refer to the User's Guide/Operating Instruction to ensure that all the correct operation procedures have duly been followed. In particular, kindly refer to any troubleshooting guide that may have been supplied with the Product(s).
  d.   PM shall not be liable for any indirect, incidental, special, punitive or consequential damages or damages, including but not limited to any lost of profits, savings, data or loss of use, any third party claims, and any injury to property or bodily injury to any person, arising from or relating to the use of the product or arising from breach of warranty or contract, negligence, tort or strict liability, even if PM, have been notified of the possibility of such damages.
  9.7    In the event that the end-user purchaser requires service assistance, please contact the CCC at +603-5543 7600. Alternatively, the end-user purchaser may send the Product(s) to Panasonic Authorised Service Centre. Please provide full details of the product model number and serial number, date of purchase and proof of purchase/warranty card and a brief description of the fault/query when contacting our Panasonic Authorised Service Centre.
  9.8    If PM determines that the claim is not covered under the warranty for whatever reason, the Customer will be duly notified. If the Customer authorises PM to repair the Product(s) which is not covered under the warranty, the Customer shall pay all the charges for all parts, shipping, and labour for the repair and return of the Product(s).
  9.9    Refer to warranty card by product categories:

  9.10    Panasonic Extended Warranty
  a.   Panasonic Extended Warranty ('PEW') is an optional add-on for Panasonic Product(s)' owners who wish to extend their original product warranty period. As an added benefit, PEW covers only a one time claim from damages caused by lightning or fire.
  b.   PEW is only offered from the time of purchase of the Product(s) and post purchase sign-ups are not allowed.
  c.   PM will conduct diagnostic tests on the Product(s) to determine the cause of the failure or defect in the Product(s) before any claim would be validated.
  d.   If PM validates a product under PEW, PM has the following options:-
  i.   repair the Product(s) at the cost of PM, using part or parts which are new or equivalent to new in performance or reliability. Any part or parts replaced by PM or by PM's authorised service dealers shall become the property of PM; or
  ii.   Exchange the product with a new product or equivalent to new in performance or reliability (whereby the function, performance and reliability is similar to the original product). PM will not refund the difference between the value of the replacement and the Product(s). The Product(s) for which the exchange is provided shall become the property of PM.
  e.   PM may refuse to attend to any product installed in locations which are inaccessible and/or hazardous to its service agents.
  f.   The Customer shall be liable for insurance, labour, delivery and transport charges for any Product(s) sent to PM and from PM to the Customer's address or such other address the Customer so nominates.
  g.   The Customer shall remove any option, feature, parts, accessories or attachments to the Product(s) prior to sending the Product(s) for a claim under PEW failing which PM shall not be liable for and damage or loss of such option, feature, parts, accessories or attachments. The Customer shall also be liable for labour charges for removing and reattaching the option, feature, parts, accessories or attachments of the Product(s).
  h.   If PM determines that the claim is not covered under the PEW for whatever reason, the Customer will be duly notified. If the Customer authorises PM to repair the Product(s) which is not covered under the PEW, the Customer shall pay all the charges for all parts, shipping, and labour for the repair and return of the Product(s).
  10.    Returns & Refunds
  1.   Buyers will have 3-7 days from the date of Delivery Order to inform in writing of its intention to return delivered goods due to damaged, malfunction, failed delivery, misinformation and/or inadequate delivery (quantity, attributes, missing parts and/or model type).
  2.   Buyers shall need to upload, share and/or send photos (before and after unboxing) of package or parcel together with the said unit to PM’s customer service for inspection purposes. .
  3.   Collection of products from Buyer’s location (as per delivery order) shall only be made once the findings of inspection is confirmed. Collection will not cover for cancellation and/or return due to change of mind reason (Buyer to return the product to PM warehouse at own cost).
  4.   PM reserve the right at its sole discretion to inspect and determine whether a Buyer will receive a refund. Decisions made from such findings is final and not appealable. Refund process shall be initiated once the product is returned to warehouse; or collected from the Buyer’s location (as per delivery order).
  5.   Refund payout will be made subject to initial transaction method made by the Buyer upon purchasing the said product. The processing period to refund Buyer shall be determined according to the initial payment method used thereof.

Panasonic e-Point System
TERMS AND CONDITIONS


Important Note:

  A.    The Panasonic e-Point System (e-Point) is an online business tool to facilitate data collection, promotion, marketing and incentive rewards to Panasonic customers purchasing and registering products warranty available at Panasonic Malaysia Online Store only.
  B.    Applicants are advised to read and understand the following Terms and Conditions before submitting any e-Point application. Upon submitting the e-Point application you are deemed to have read, understood and agree to the said Terms and Conditions. This Terms and Conditions shall not supersede or override existing Club Panasonic or other applicable Panasonic Terms and Conditions whereupon not overlapping with the former.
  C.    e-Point's intellectual property rights shall be vested with Panasonic Malaysia Sdn Bhd (PM). All published materials (printed or electronic), visual/audio images, display items permanent or temporary representation on e-Point shall not be republished, reproduced or imitated without the written consent of PM.
  D.    All matters pertaining to the registration, evaluation, verification and redemption of the e-Point shall be done at the absolute discretion of PM complying with existing laws including but not limited to the Personal Data Protection Act 2010. All registered customers and dealers shall comply with all standing and ad-hoc requests, recommendations, advice and/or instructions issued by PM thereof.
  E.    PM reserve the right to request additional documents such as official receipts, photograph of products, etc. to verify validity of purchases.
  F.    PM reserve the right to amend, revise and/or review the mechanics of redemption whenever it is deemed necessary. [It is advised not to mention any advance notification period to consumers. Any technical changes to redemption mechanics shall be informed to dealers separately.]
  G.    e-Points are exclusively only available, applicable and redeemable to and/or by end consumers. Dealers or sub dealers are not entitled to any consumer-based benefits and interest accumulated from e-Points.
  H.    Redemptions of e-Points of products purchased at Panasonic Malaysia Online Store are to be applied and submitted by consumers for verification and processing purposes thereof. Registration of warranty product by appointed dealers will not be given e-Point. Accumulation of related e-Point redemption values shall be credited to the said consumer's account unless request otherwise by the same in writing to the dealer.

 1. Introduction and Registration

  1.1    In order to be eligible to qualify for e-Point benefits, the following basic criteria have to be complied:
  i.   Legitimate Malaysian citizen; and
  ii.   Age 18 years and above; and
  1.2    The e-Point is open to existing and new Club Panasonic Members for all products purchased at Panasonic Malaysia Online Store only. Customer have to register as a member to entitle for e-Points at http://club.panasonic.com.my in accordance to the following steps:
      The actual e-Points acquired will be reflected in the Panasonic Malaysia 'Online Store' under 'My Account' at https://direct.panasonic.com.my
  1.3    Registered customers may track and manage their acquired e-Points at the Panasonic Malaysia Online Store at https://direct.panasonic.com.my 
in accordance to the following steps:
  i.   go to 'My Account' and clicking on the 'e-Points' to check collected e-Points; and
  ii.   click on the 'e-Points Transaction' to obtain e-Points transaction details.
  1.4    e-Points acquired by customers upon registering on Club Panasonic website are valid for thirty six (36) months from date of issue.
  1.5    All unclaimed e-Points shall be deducted at the expiry thereof. e-Points deduction sequence shall commence from earliest dates of acquisition to subsequent dates thereafter.

 2. Redemption of e-Points

  2.1    Accumulated e-Points can be redeemed for e-Vouchers to further purchase Panasonic products at the Panasonic Malaysia Online Store (PMOS). e-Vouchers represent certain monetary value corresponding to amount e-Points customers have acquired and retained.
  2.2    e-Points are stored at PMOS under 'My Account'. To access, you are required to login from Club Panasonic website. To redeem your e-Points for e-Vouchers to purchase other Panasonic products, click on to 'e-Points Redemption' button. Thereupon customers are required to select the preferred denomination of e-Voucher ranging from RM10, RM50 and RM100. Once the said selection is done, customer can click on 'My Vouchers' to check the amount and quantity of e-Vouchers redeemed.
  2.3    To view any e-Points collected & redeemed, customers may click on the 'e-Points Transaction' button. Alternatively, to check on available e-Vouchers, click on 'My Voucher' button. Customers may opt to use e-Vouchers as partial payment for any purchase of Panasonic products and to top up the remaining balance via credit card payment.
  2.4    e-Vouchers can only be redeemed for all Panasonic products listed in the Panasonic Malaysia Online Store at http://store.apac.panasonic.com.my. Each e-Voucher can only be used in a single transaction. Redemption of e-Vouchers will depend on availability of stock.
  2.5    Where any price of a purchased Panasonic product is less than the value of the e-Voucher, no refunds will be given. On the other hand where any price of a purchased product is more than the value of the e-Voucher, the customer is required to pay/top-up the remaining balance.
  2.6    Each e-Voucher is valid for six (6) months from the date of issue. There will be no re-issuance of e-Voucher upon the expiry date. No replacements or extension will be given for expired e-Vouchers.
  2.7    Redeemed e-Vouchers are non-refundable, non-transferable and non-exchangeable for cash.
  2.8    Customers not clear or uncertain on any registration and redemption process may contact Panasonic Malaysia Customer Service Centre at 03-7953 7600 during business hours (Monday-Friday: 9am-5pm) or email to ccc@my.panasonic.com.

 3. Seasonal Promotion

  3.1    Panasonic Malaysia will at its absolute discretion, from time to time, offer promotional benefits and incentives to customers having purchased Panasonic brand products and registered as Club Panasonic.
  3.2    Such promotions shall be undertaken pursuant to seasonal offers and campaigns, including but not limited to the followings:
  i.   e-Vouchers; and
  ii.   Birthday e-Vouchers
  3.3    The mechanics, benefits and period of each promotional offers will be informed to customers subject to applicable terms and conditions thereof.
  3.4    e-Vouchers and/or e-Points accumulated throughout such promotional period (if any) shall be assessed, accounted and redeemable as per above mentioned terms and conditions.
  3.5    Panasonic Malaysia reserves the right to cancel, suspend or revise any such promotional offer without prior notice.

TERMS AND CONDITIONS


 1. Definitions

  1.1    "PM", means Panasonic Malaysia Sdn. Bhd. (26975-W) who is selling products to the Customer as identified in PM’s order form.
  1.2    "Product(s)" means product(s) and/or its/their peripheral product(s) by Panasonic listed as shopping items on this Website (including but not limited to Panasonic Products) and forming the subject matter of this contract as identified by Customer in the order form.
  1.3    "Customer" means a person or legal entity who orders the Product(s) via this Website.
  1.4    "Contract" means a contract containing these terms and conditions agreed upon between PM and the Customer for sale by PM and purchase by the Customer of the Product(s).
  1.5    "Panasonic Product(s)" means product(s) sold under the trademark "Panasonic" and/or other trademarks owned or used by Panasonic and listed as shopping items on this Website.
  1.6    "Accessories" means computer software, recording media such as cassette and video tapes, connecting cables, batteries, camera tripods and other optional or peripheral accessories sold for use with Panasonic Product(s).
  1.7    "Order ID" means the Customer Reference Number automatically generated and provided to Customer by PM upon Customer placing an order.
  1.8    "Working Day" means a day, from Monday to Friday which commercial banks in Kuala Lumpur are open for business, excluding Saturdays, public holidays and gazette public holiday.
  1.9    “Order date” means the day when customer receive the notice of acceptance from PM.
  1.10    “CCC” means PM Customer Care Centre.
  1.11    “Panasonic” means Panasonic Corporation, Japan and such other related companies of Panasonic Corporation, Japan which is in the business of manufacturing Panasonic Product(s).

 2. Sales Contract

  2.1    Sales & Purchase
PM shall sell and the Customer shall purchase the Product(s) in compliance with the Contract.
  2.2     Order / Formation of Product
  2.2.1   All orders of the Product(s) placed by the Customer via this Website shall be subject to acceptance by PM, which acceptance is at the discretion of PM. Upon the Customer placing an order, a unique Customer Order ID will be automatically generated and provided to the Customer to facilitate tracking of the Customer's order. The provision of such Order ID does not operate as an acceptance of the Customer's order and merely serves as confirmation that the Customer's order has been received by PM.
  2.2.2   The Contract shall come into existence when the Customer receives a notice of acceptance of the order from PM. In the event that an order is rejected, PM is not required to give any reason for the rejection.
  2.2.3   PM will only accept orders for delivery of the Product(s) to the street address of the Customer in Malaysia from residents of Malaysia who have attained the age of 18 years.
  2.2.4   PM reserves the right to limit quantities of the Product(s) purchased in any order.

 3. Acceptance

      Unless the Customer notifies PM to the contrary by telephone, email or facsimile transmission within 3 – 7 working days of delivery and such notification is confirmed in writing within 3 - 7 working days of the notification, the Product(s) shall be conclusively deemed to have been accepted by Customer as being in good condition and in accordance with the Contract. Subject to the Customer's statutory rights, PM will not entertain any request to return or exchange for the Product(s). In the case of defective Product(s) under warranty which is declared by PM as a manufacturer defect (please refer to clause 7, service policy and warranty), PM reserves the right, at its sole discretion, to repair such defective Product(s) in lieu of replacing the same with equivalent products.

 4. Title, Risk of Loss or Damage

      Title and risk of loss or damage to the Product(s) shall pass to the Customer on the physical delivery of the Product(s) to the address identified by the Customer in the order. Notwithstanding the foregoing, title to the Product(s) that are software products shall remain with the applicable licensor(s).

 5. Support

  5.1    PM offers support to the Customer for Panasonic Product(s) through telephone, email or facsimile transmission.
  5.2    PM will not offer support to the Customer for problems relating to any software or hardware products licensed or manufactured by any party other than Panasonic [or Panasonic Corporation, Japan]. If the Customer needs such support, Customer should contact the respective supplier or licensor of each such software or hardware product.
  5.3    The details of the Support are set out in the Customer Service page at http://www.panasonic.com.my or are available upon request from CCC at ccc@my.panasonic.com or +603-7953 7600.

 6. Critical Components

      The Product(s) are not authorized for use as critical components in life support systems or situations where failure to perform can reasonably be expected to cause significant injury to users or others.

 7. Changes

      PM may update or discontinue any of Product(s) and/or revise prices for the Product(s) listed as available items on this Website or elsewhere at any time. Therefore, the Customer agrees that changes between the shipped Products and the Products described in marketing materials (advertisements, catalogues, specification sheets etc.) may occur. All orders are accepted on these terms, which supersede any other terms appearing in this Website or elsewhere and shall override any other terms referred to by the Customer or in any course of dealing.

 8. Resale

      The Customer agrees and warrants that the purpose of purchasing the Product(s) is for the Customer's own individual or personal use only, and not for resale. PM shall be entitled to refuse to accept orders placed by the Customer if the Customer breaches or PM, on reasonable grounds, suspects that the Customer will breach this warranty. The Customer shall not remove components from the Product(s) for resale.

 9. Export Restrictions

      The Customer agrees to comply with all applicable export laws, regulations and orders of Malaysia, Japan and the United States of America. Specifically, but without limitation, the Customer agrees that it will not re-export or ship, directly or indirectly, any Product(s) or technical data in any form without first obtaining PM's prior written consent and the appropriate export or re-export licenses from the Government of Malaysia, the Government of Japan and/or the Government of the United States of America.

 10. Waiver / Invalidity

      Failure of PM to insist upon strict performance of any provisions hereof shall not be deemed a waiver of its right and remedies. If any provision of the Contract is deemed by a court to be unenforceable, the remainder shall stay in effect.

 11. Governing Law

      The Contract shall be governed by and construed in accordance with the laws of Malaysia. The parties hereto submit to the non-exclusive jurisdiction of the courts of Malaysia, that being the place where the Customer's order has been received and/or entered and accepted.

 12. Entire Agreement

      These terms and conditions may not be altered, supplemented, or amended by the use of any additional document(s) that purport to be an agreement of the parties. Any attempt to supplement or amend this document or to enter an order for the Product(s) that is subject to additional or altered terms and conditions shall be null and void and of no effect whatsoever.

      PM shall not be liable for any delay in performing any of its obligations under the Terms and Conditions herein contained if such delay is caused by any circumstance beyond the reasonable control of PM so delaying, and PM shall be entitled to a reasonable extension of time for the performance of such obligations.
